1. Acceptance of Terms

These Terms of Service ("Terms") constitute a binding agreement between you ("you" or "User") and Blum Realty Group, a California-licensed real estate brokerage ("Brokerage," "we," "us," or "our"), governing your access to and use of the website located at blumrg.com and any related digital properties, content, and services (collectively, the "Site"). By accessing, browsing, or otherwise using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, you must not use the Site.

We reserve the right to modify, update, or replace these Terms at any time, in our sole discretion. Material changes will be reflected by updating the "Last Updated" date above. Your continued use of the Site after any such change constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

2. Service Description

Blum Realty Group provides residential real estate brokerage services in the State of California, including buyer representation, listing services, market analysis, and the digital display of multiple-listing-service ("MLS") data via licensed third-party providers. The Site is intended as an informational resource for prospective buyers, sellers, and the general public to research properties, market conditions, and the services we offer. The Site is not intended to provide legal, tax, financial, or appraisal advice, and nothing on the Site should be construed as such advice.

3. MLS Data Attribution

Listing data displayed on the Site is provided in cooperation with the San Diego Multiple Listing Service, Inc. ("SDMLS") and other participating MLSs, pursuant to applicable Internet Data Exchange ("IDX") rules. The IDX information is provided exclusively for personal, non-commercial use by consumers, and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing. Information deemed reliable but not guaranteed. All listing data is provided "as is" and may be subject to delay, error, or change without notice. Properties may be subject to prior sale, change, or withdrawal at any time. Square footage, lot size, school assignments, and other data points are approximations and should be independently verified by the consumer.

You agree to use the Site solely for lawful, residential consumer purposes. Without limiting the foregoing, you specifically agree NOT to:

No account is required to browse public portions of the Site. You may voluntarily register to access enhanced features such as saved searches, listing favorites, and email alerts. If you choose to register, you agree to provide accurate, current, and complete information, and to keep that information up to date. You are responsible for safeguarding your login credentials and for any activity that occurs under your account. We reserve the right to suspend or terminate any account in our sole discretion, with or without notice, for any reason, including violation of these Terms.

6. No Warranty / "As Is"

THE SITE, INCLUDING ALL CONTENT, MLS DATA, PHOTOGRAPHS, AND FUNCTIONALITY, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, nor that any defects will be corrected. We make no representation or warranty regarding the accuracy, completeness, currency, or reliability of any listing data, valuation, school information, neighborhood data, or other content. You acknowledge that the Brokerage is not responsible for, and shall not be liable for, errors, omissions, or inaccuracies in MLS data sourced from third-party providers.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE BROKERAGE, ITS OFFICERS, AGENTS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF THE SITE SHALL NOT EXCEED FIVE U.S. DOLLARS ($5.00) OR THE AMOUNT YOU PAID US TO USE THE SITE (WHICHEVER IS GREATER), WITH THE PARTIES ACKNOWLEDGING THAT BROWSING THE SITE IS FREE OF CHARGE. NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING WITHOUT LIMITATION CALIFORNIA CIVIL CODE SECTION 1668 (FRAUD, WILLFUL INJURY, OR VIOLATION OF LAW).

8. Indemnification

You agree to defend, indemnify, and hold harmless the Brokerage, its officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including reasonable attorneys' fees) arising from: (a) your use of, or inability to use, the Site; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any intellectual-property, privacy, or proprietary right; or (d) any content you submit, post, or transmit through the Site. This indemnification obligation will survive these Terms and your use of the Site.

9. Mortgage Loan Originator Disclosure

Frederick Blum is a licensed Mortgage Loan Originator under personal NMLS ID #1914546, with company NMLS ID #2468904. Any mention of mortgage products, financing, or lender programs on the Site is for informational purposes only and does not constitute a commitment to lend, an offer to extend credit, or a guarantee of loan approval, rate, or terms. All loans are subject to credit approval, underwriting, property appraisal, and program guidelines, and rates and terms are subject to change without notice. Equal Housing Lender. 10. DRE Compliance Disclosure

Blum Realty Group is licensed by the California Department of Real Estate ("DRE"). Brokerage DRE License #02325109. Frederick Blum, Broker/Owner, holds personal DRE License #02040760. Information regarding the licensing status, complaint history, and disciplinary record of any California real estate licensee may be obtained from the California Department of Real Estate at www.dre.ca.gov.

11. Governing Law & Venue

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles. You agree that any legal action, suit, or proceeding arising out of or related to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in San Diego County, California, and you irrevocably consent to the personal jurisdiction and venue of such courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

12. DMCA / Copyright

All real estate listing photographs, virtual tours, video content, listing descriptions, and other media displayed on the Site are subject to copyright protections held by their respective owners, including listing brokerages, photographers, and other content creators, in accordance with the California Code of Real Estate Photography ("CCREP") and federal copyright law. The display of such content on this Site is licensed solely for the limited IDX purposes described in Section 3. Any unauthorized reproduction, distribution, or commercial use is strictly prohibited.

If you believe that content on the Site infringes your copyright, please send a written notice meeting the requirements of the Digital Millennium Copyright Act ("DMCA") (17 U.S.C. Sec. 512) to the contact below. The notice should include: (i) a physical or electronic signature of the copyright owner or authorized agent; (ii) identification of the copyrighted work claimed to be infringed; (iii) identification of the allegedly infringing material and its location on the Site; (iv) your contact information; (v) a statement of good-faith belief that the use is not authorized; and (vi) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act.

13. Termination

We may suspend or terminate your access to all or any part of the Site at any time, with or without cause, with or without notice, effective immediately. All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, limitations of liability, and governing-law provisions.
